Terms of Service

Welcome to Keepop! These Terms of Service ("Terms") govern your access to and use of the Keepop mobile applications, the Keepop website at app.keepop.io, and related services (collectively, the "Service") provided by EMOTA SAS ("we", "us", or "our"). By using Keepop, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, downloading, accessing, or using Keepop, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 13 years old to use Keepop. By using the Service, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and up-to-date

3. Account Registration and Security

3.1 Account Creation

To use certain features of Keepop, you must create an account by providing:

  • A valid email address
  • A secure password
  • Your country of residence

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

We are not liable for any loss or damage arising from your failure to protect your account information.

3.3 Account Termination

You may delete your account at any time by contacting us at hello@keepop.io. We reserve the right to suspend or terminate your account if you violate these Terms.

4. License and Usage Rights

4.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Keepop for personal, non-commercial purposes.

4.2 Restrictions

You agree NOT to:

  • Modify, reverse engineer, decompile, or disassemble the app
  • Copy, distribute, or create derivative works from the Service
  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt the Service or servers
  • Use automated tools (bots, scrapers) to access the Service
  • Impersonate others or provide false information
  • Upload malicious code, viruses, or harmful content

5. Subscription and Payments

5.1 Free Plan

Keepop offers a Free Plan with limited features at no cost:

  • Track up to 3 groups maximum
  • 1 bias per group
  • Access to Album Collection and Album Photocards tabs only
  • Basic statuses (Have/Don't have)
  • General collection statistics

We reserve the right to modify or discontinue the Free Plan at any time.

5.2 Premium Subscriptions

Keepop offers two Premium subscription options:

  • Premium Monthly: €1.99/month with 1-month free trial
  • Premium Annual: €14.99/year (no free trial)

Premium features include:

  • Unlimited groups and biases
  • Access to all tabs (Inclusions, Media, Photobook, Merch, All Photocards)
  • All photocard types (Standard, Benefit, Merch, POB, Broadcast, etc.)
  • All statuses (Have, Don't have, In Transit, GO)
  • Complete statistics (Global, by group, by bias)
  • Priority support

By subscribing, you agree to:

  • Pay the subscription fee displayed at the time of purchase
  • Automatic renewal unless you cancel before the renewal date
  • Premium subscriptions are processed through the Apple App Store or the Google Play Store

5.3 Free Trial

The Premium Monthly subscription includes a 1-month free trial. The Premium Annual subscription does not include a free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, you will be automatically charged for the Monthly subscription.

5.4 Pricing Changes

We reserve the right to change subscription prices at any time. Price changes will apply to new subscribers immediately and to existing subscribers upon renewal (with advance notice).

5.5 GOM (Group Order Manager) Subscription

The GOM subscription is a separate plan for users who organize group orders. It is available on the Keepop website only (at app.keepop.io) and is not sold inside the mobile apps.

  • GOM Monthly: €4.99 per month, VAT included
  • GOM Annual: €49 per year, VAT included

The GOM plan includes all Keepop Premium features, plus the tools to create and manage group orders (claims, payments, packages, shipping and storage).

New GOM users are offered a one-month free trial without a payment card. The trial does not renew into a paid plan on its own: when it ends, access to the GOM tools stops until you choose a paid plan. You may only use this trial once.

By subscribing to a paid GOM plan, you agree to:

  • Pay the price displayed at the time of purchase
  • Automatic renewal at the end of each billing period, until you cancel
  • Payment being processed by Stripe, our payment provider. Keepop never receives or stores your card details

Keepop provides the software used to run a group order. Keepop is not a party to the group order itself: the contract for the goods is between the group order manager and the participants. Managers are responsible for their own compliance with the laws that apply to them, including consumer, tax and shipping rules.

5.6 Cancellation and Refunds

Premium subscriptions (mobile apps):

  • You can cancel at any time through your Apple App Store or Google Play Store account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial subscription periods
  • Refund requests are handled by Apple or Google according to their policies

GOM subscription (website):

  • You can cancel at any time from your profile page, using the "Manage subscription" link, which opens the Stripe customer portal
  • Cancellation takes effect at the end of the current billing period; you keep access until then
  • No refunds for partial billing periods, except where required by law
  • If you already pay for Premium through the App Store or Google Play, cancelling that subscription is a separate step that only you can do, from your store account

Right of withdrawal (EU consumers): when you subscribe to a paid GOM plan, you ask for the service to start immediately. By confirming your purchase you acknowledge that you lose your 14-day right of withdrawal once the service has been fully provided, in accordance with Article L221-28 of the French Consumer Code.

6. User Content and Profile Information

6.1 Your Profile Data

You retain ownership of any profile information you add to Keepop, including:

  • Profile picture (coming soon)
  • Social media links
  • Personal information in your profile

6.2 Collection Tracking

Keepop allows you to track your K-pop collection by marking which albums, photocards, and merchandise you own from our curated database. The albums, photocards, and merchandise data in our database are added and maintained by our development team.

6.3 Content Guidelines

You agree that your profile information will NOT:

  • Violate any laws or third-party rights
  • Contain hate speech, harassment, or discrimination
  • Include explicit, obscene, or inappropriate material
  • Infringe on intellectual property rights

We reserve the right to remove content that violates these guidelines.

7. Marketplace, Trades and Group Orders Between Users

Keepop lets you show what you own, what you are looking for, and what you are willing to sell or trade. Other members can browse those listings and contact you. Group orders work the same way: a group order manager (GOM) organises the purchase, and participants join it.

7.1 Keepop is not a party to your transactions

Keepop is software that helps you track and organise. It is not a shop, a marketplace operator holding funds, an escrow service, or an intermediary in your sales. When you sell, buy, trade or join a group order:

  • The contract is between you and the other member. EMOTA SAS is not a party to it.
  • Payments happen directly between members, through the means they choose. Keepop never receives, holds, or transfers your money, and cannot reverse a payment.
  • Keepop does not verify the existence, ownership, condition, or authenticity of any item listed, and does not check that a member will ship what they promised.
  • Shipping, customs, insurance and delays are handled entirely between the members concerned.

7.2 Disputes

Disagreements about payment, shipping, condition or authenticity are settled between the members involved. Keepop does not arbitrate, does not refund, and does not compensate. We may, at our discretion, remove a listing, close a group order or suspend an account, but that is a moderation decision — never a ruling on your dispute, and it does not create any obligation for us to intervene.

Report abuse to support@keepop.io. Keeping your own proof (messages, payment receipts, tracking numbers) is your responsibility.

7.3 Your obligations as a seller or group order manager

  • Only list items you actually own and are allowed to sell.
  • Describe them honestly, including their condition.
  • Comply with the laws that apply to you. If you sell regularly and for profit, you may be considered a professional seller in your country, with the obligations that follow — including consumer information, right of withdrawal, and declaring your income. Deciding whether that applies to you is your responsibility, not ours.
  • Group order managers publish their own rules. Participants must accept those rules before their first claim. Those rules bind the manager and the participants — not Keepop.

7.4 Prohibited listings

You may not list counterfeit goods, stolen items, anything you do not have the right to sell, or anything whose sale is restricted by law. We remove such listings and may suspend the account behind them.

8. Intellectual Property

8.1 Our Intellectual Property

Keepop, including its design, features, code, graphics, logo, and trademarks, is owned by EMOTA SAS and protected by copyright, trademark, and other intellectual property laws. You may not use our intellectual property without written permission.

8.2 K-pop Content

Keepop allows you to track K-pop albums, photocards, and merchandise. All K-pop-related content (album covers, artist names, group names) is owned by their respective copyright holders. We do not claim ownership of any third-party content.

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

Keepop is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Guarantees of uninterrupted, error-free, or secure service
  • Accuracy, reliability, or completeness of content

9.2 Limitation of Liability

To the fullest extent permitted by law, EMOTA SAS shall not be liable for:

  • Any indirect, incidental, consequential, or punitive damages
  • Loss of data, profits, revenue, or business opportunities
  • Service interruptions, errors, or bugs
  • Third-party actions or content

Our total liability shall not exceed the amount you paid for the Service in the 12 months prior to the claim.

9.3 No Responsibility for Third-Party Services

We are not responsible for the practices or content of third-party services (Apple App Store, Google Play Store, Firebase) integrated with Keepop.

10. Indemnification

You agree to indemnify and hold harmless EMOTA SAS, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Your content or conduct

11. Privacy

Your use of Keepop is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

12. Modifications to the Service and Terms

11.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation.

11.2 Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by:

  • Posting the updated Terms on this page
  • Updating the "Last updated" date
  • Sending an in-app notification or email

Your continued use of Keepop after changes constitutes acceptance of the new Terms.

13. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of France, without regard to conflict of law principles.

12.2 Jurisdiction

Any disputes arising from these Terms or your use of Keepop shall be subject to the exclusive jurisdiction of the courts of Toulouse, France.

12.3 Dispute Resolution

Before initiating legal action, you agree to contact us at hello@keepop.io to attempt to resolve the dispute informally.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EMOTA SAS regarding the use of Keepop and supersede any prior agreements.
